Terms and Conditions Locusta Garments

Article 1: Definitions
In these terms and conditions, the following terms are defined as:
1.1. Locusta Garments: the trade name of the webshop selling clothing, located at Koningin Julianaweg 8, 2691GD, 's-Gravenzande, The Netherlands, registered with the Chamber of Commerce under number 95871063.
1.2. Customer: any natural or legal person who places an order with Locusta Garments.
1.3. Agreement: any agreement between Locusta Garments and the customer, including the terms and conditions.
1.4. Products: all clothing items and related articles offered by Locusta Garments via the webshop.

Article 2: Applicability
2.1. These terms and conditions apply to all offers, orders, and agreements of Locusta Garments.
2.2. By placing an order, the customer accepts the terms and conditions.
2.3. Deviations from these terms are only valid if agreed upon in writing.

Article 3: Offers and Prices
3.1. All offers and prices on the webshop are non-binding and include VAT unless stated otherwise.
3.2. Locusta Garments reserves the right to change prices and information.
3.3. Errors in prices or product descriptions do not bind Locusta Garments.

Article 4: Orders and Formation of the Agreement
4.1. An agreement is concluded when Locusta Garments confirms the customer's order via email.
4.2. Locusta Garments reserves the right to refuse an order or request additional information.

Article 5: Payment
5.1. Payment must be made using the payment methods offered by Locusta Garments.
5.2. The customer is obliged to immediately report inaccuracies in provided or stated payment details.

Article 6: Delivery and Delivery Time
6.1. Locusta Garments aims to deliver orders within 2-3 business days.
6.2. Exceeding the delivery time does not entitle the customer to compensation.
6.3. Delivery takes place at the address specified by the customer.

Article 7: Returns and Right of Withdrawal
7.1. The customer has the right to cancel the order within 14 days of receipt without giving any reason.
7.2. Products must be returned unworn, undamaged, and in their original packaging.
7.3. The costs of return shipping are borne by the customer unless agreed otherwise.
7.4. Locusta Garments will refund the full purchase amount within 14 days of receiving the return shipment.

Article 8: Warranty and Complaints
8.1. Locusta Garments guarantees that the products comply with the agreement, the specifications, and reasonable standards of quality.
8.2. Complaints about the products must be reported within 7 days of discovery.
8.3. Locusta Garments will handle complaints as quickly as possible and provide an appropriate solution.

Article 9: Liability
9.1. Locusta Garments is not liable for indirect damage, such as consequential damage, loss of profit, or loss of data.
9.2. The liability of Locusta Garments is limited to the amount paid by the customer for the product.

Article 10: Privacy
10.1. Locusta Garments processes personal data in accordance with applicable privacy legislation.

Article 11: Applicable Law and Disputes
11.1. All agreements and disputes are governed by Dutch law.
11.2. Disputes will be submitted to the competent court in the district where Locusta Garments is located.
